    Expungement and Background Check
    My question involves criminal law for the state of: North Carolina

    I was charged with 16 counts of obtaining property under false pretence after a long legal battle and restitution the charges were dismissed. I applied for expungement and it was granted and enter into the computer in the county that I was charged. I was let to believe that once enter it would not become public record right away. Then, I found out that it has to go thru the sheriff office first and then to the SBI to be really taken out of the system. I was also told it could take up 3 months for the process. My question is there a way to make this process faster? I was offered a great job with a local bank and I'm afraid they will turn me down if they find out about it.
    Is amazing to me that I have done everything humanly possible to take care of the matter and after 5 years I still can not get a Job. Any suggestions?

    There may be ways for various bureaucrats to move more quickly, should they chose, but there's no mechanism for you to compel them to put your case ahead of the others backlogged in front of you.

    Like writing to your congressman? attorneys General? etc...

    If you have time, paper, stamps and envelopes, you can write all the letters that you want.

    There would be no point in sending letters to federal officials over a state law issue, or writing to administrators outside of the agency/agencies you believe is/are acting too slowly.

    A certain amount of time must lapse after the judge signs the expunction order. Why? To see if any of the agencies holding the record are going to protest the expunction order.

    It sucks that the system is so screwed up! I am not guilty of anything but I'm still being punished. The Law says that once the order is entered in the system is not public record any longer so why I have to wait months for the State to do the same.

    If you and your fellow North Carolinans would like to have your taxes raised so as to hire more state employees so as to proceed with your demands faster, I'm sure that can be arranged.

    But if you are looking for a law you can invoke that will force the state to deal with your issue immediately instead of in its turn, above other citizens who may have been waiting as long or longer than you, there isn't one.

    I'm talking for everyone that is waiting, and yes I pay taxes so scumbags can stay at home and do nothing!

    We cannot say what your culpability in the situation is. Apparently the system is working to some extent, or you would have been found guilty initially.
