First Time Offender
My question involves criminal law for the state of: Washington. I am being charged with Possession with intent to distribute a controlled substance, and forging a prescription for that same substance. They are Class B and Class C felony, respectively. I have no prior record, and this is my first offense. I cannot afford a lawyer. I am unemployed. I successfully completed a 2-month drug rehabilitation program that I entered voluntarily. Does anyone know what the average sentence is for these crimes? I know the maximum penalties.

Re: First Time Offender
Nobody here can tell you what the "average" sentence is because there is no such thing. What sentence you can expect if you are convicted depends on many factors. You need to consult an attorney that can review your case, your criminal history, and is familiar with the prosecutors and judges where your case will be tried.
You say you have no record and this is your first offense. Does that mean you have never been arrested (not convicted, i said arrested) for any crime, or just nothing drug related? Have you ever had a deferred prosecution? When you voluntarily completed the rehab, did you have any pending charges? Do the prosecutors and/or judges in your area take a harsh stance on drug crimes? Are there any community or political pushes against drug crimes in your area right now? How old are you? Did you actually sell/give or attempt to sell/give drugs to anyone? If so, was it a 7th grader, your 30 y/o girlfriend, or an undercover police officer? What drug are we talking about? Where did you get the prescription pad? What were the circumstances by which you obtained the drugs?
These are all questions that could play a role in how harsh of a sentence the prosecutor is likely to push for and how harsh a judge is likely to be at sentencing. Since nobody here is likely to know any of these answers, you need to consult with an attorney.
