Open Container Ticket With a Pending Conditional Discharge
My question involves criminal law for the state of: New York
Just under a year ago I was charged with possession and sale of marijuana. Charges were dropped to violations given a conditional discharge that i dont get anything more than a traffic ticket within the next year.
Just before my year ended I received an open container ticket in NYC.
I have a couple of questions.
1. I've heard people say that open container tickets are comparable to traffic tickets in NYC, will it have an effect on my conditional discharge?
2. I was unaware of being able to plead not guilty for the open container, could I still plead not guilty even though my 48 hours to do so is up?
(the only reason I'd plead not guilty is because the cop wrote the wrong address on my citation, as well as never checked my bottle of vitamin water which i told him was vitamin water [which it was] but still gave me a ticket and told us not to speak. he also didnt make us dispose of any of the alcohol that was present in my friends cup)
I'm more worried of this citation affecting my conditional discharge, can anybody please help me out? Im not sure of what to do...
Re: My Conditional Discharge + an Open Container Ticket in NYC
It is entirely up to the court that gave you the conditional discharge, I wouldn't be so sure just because your were given a violation rather than a misdemeanor means you're home free.
