Does the Custodial Parent Have the Right to Say Who Can Watch the Children
My question involves a child custody case from the State of: Ohio
I am not confortable with my children's father's choice in girlfriend. The last one threatened to keep my kids when she had no right to them. (Kidnapping?) I dont know her, I know absolutly nothing about her and he has decided to move in with her. While he works weekends, that would leave my children with her. I asked to meet, sit and kinda get to know each other. He said she didnt feel comfortable having a private conversation with me without him there. How am I supose to allow her to have a personal relationship with my children when she cant sit and have a conversation with me? What can I do legally? I dont know her and I dont want my children left with her.

You can't do anything. It's entirely up to Dad who he exposes the kids to during his parenting time, and he's allowed a choice in who babysits.
Would it be nice to have a sit down chat with her? Sure. But she's not obliged to do so.
Do you have an issue with sitting down with him present? He seems to have indicated that the girlfriend would be okay with that.

In a word: no.
Unless you have evidence your children are in danger from the situation, you have no control over the children when they are in the care of the father. Think of what he could do if you could control the situation. Would you want him telling you he does not like your choice in men, type of car, where you live, or anything else and have the right to demand you alter any or all of them?
You have no right to demand a meeting with the girlfriend.

No, I dont have an issue sitting with him present but I dont want to hear his chatter while I'm trying to speak with her. My husband said if I had full custody of them then I could have him do supervised visitation. Is that true?
He has shown many times that he has horrible parenting judgement and yes I have picture proof along with cps documents. Does that mean anything?

only if you can justify the need for supervised visitation and nothing you have presented does that. It actually takes a lot to get supervised visitation ordered.

You cannot determine if he has supervised visits. Only a judge can do that. What kind of danger are you speaking of? Since you haven't given any specifics, it would seem that any perceived danger on your part is not significant enough for a judge to order supervised visits, or that you in fact cannot prove any real danger after all.
What were the CPS findings? What course of action did they recommend? Incidentally, were the reports made by you, your husband, or someone else connected to you? If CPS did not take any action against him, then you really have nothing.
Are the children in mortal danger with him? Can you prove that? Do they come home covered in bruises and you can prove that he caused them? Something along those lines? If not, then you are probably grasping at straws. If you don't like him as a father to your children, you may want to consider better parenting material for your future children.

the fact that CPS is aware of the situations causing you such concern and have not taken any action tends to show that CPS doesn't see it the same way as you do. The courts tend to see things in a similar fashion as CPS, especially since that is where the courts tend to get their recommendations from.

As the others have indicated, if CPS have not seen fit to intervene, the courts will likely also think <whatever it is> is a non-issue.

he left the state is the reason cps didnt do anything. When my oldest was 2 he was found on the block behind us by an X neighbor of ours. He has put bruses on one of my children, my 2nd child was 3 months and he slaped him in the face leaving a big hand print. He was pulled over by the police once and arrested for neglect becuase my children were not in saftey seats. He has been arrested for hitting me, and only 1 of these reports was made by me. None by anyone we know or are related to. How much more do I need to prove he is unfit?
