You just told us that the brothers have different fathers. You wouldn't know that unless both were tested.

sorry i didn't explain it very well. the two brothers were the potential fathers of said baby. one of the brothers went in and had a dna test done to see if he was the father. it came back 99.9%. is there any reason the other brother should get tested. i should also add that the two brothers themselves have different fathers.
basically there are 2 brothers with different fathers. they both were considered to be the father of a baby. 1 brother got tested it came back 99.9% pos. the other brother never got tested. should he?

Are you suggesting that the one brother is agreeing to be made the legal father based upon the 99.9% result? If so, then the other brother has the choice of getting his own test or living with that outcome.
