    What Do I Do Now After Shoplifting
    My question involves criminal law for the state of: Oregon
    I was charged with 2 class A misderminers for shoplifting about $130 worth of items. "Theft 2" and "Possession of a Theft Device".
    My questions are..
    1) When should i talk to a lawyer? i haven't even thought about it that much. Do i wait until i go to court? Are they going to give me a lawyer in court?

    2)And for the "Possession of a theft device", they said something about it being the bag i used. I had a knife but i explained that i forgot i had it and i never even thought about having it on me (etc...) and the officer trusted me and i think he didn't charge me for that. But I saw the possession of a theft device on the citation. Is that for the knife? cause i thought it was for the bag i used...

    3)Also is there a good chance of jail time? because i don't think there would be if i was very cooperative and paid fines and whatever else i can do. Plus I'm 17 and go to school and have a job. AND this is my FIRST offense. Ive never done anything wrong before. (legally of course)

    Please keep it all in the same thread. The answer hasn't changed. Your lawyer might if you're lucky work out the civil compromise. Jail isn't likely but expect probation and a lot of fines and costs. Start saving your pennies.

    If you or your parents can afford an attorney, you should hire one now. If you cannot afford an attorney, show for your first court date, plead not guilty and fill out an application for a public defender.

    If found or a plea to the charge, you most likely will not see any jail time. You will see a heavy fine, court cost and other related fees as well as probation and community service.

    What was the bag you used? Was it foil lined?

    Was the bag a plastic bag from the store? Or one of the recycled bags they sell?

    The knife....well....why did you have a knife on you?

    You will want to talk to a lawyer. Because of the above, and because $130 is not a first-time shoplifting, but a first time CAUGHT shoplifting.

    No. It was a brown paper bag with a handle from another store.

    That was a huge mistake. I was with friends earlier and i was showing it off to them and i just put it in my pocket. no where else to put it. And i really forgot about it until i was sitting in the room and i got my phone out and i felt the knife and i was thinking i was more screwed. It was really and accident and i had NO intention of using it.

    The reason I asked my question was to determine if they were charging you with the knife or the bag. I'll let you figure it out now.

    Ugh. Sorry for being rude. Im just getting more and more nervous. But yea. My dad has the knife. And the bag i just threw it out later. They gave me the bag back too though.
