Consequences of Being Caught Shoplifting
My question involves criminal law for the state of: Oregon
Im 17, and got caught stealing 170 dollars worth of stuff from Sears. None of the merchandise was damaged at all and I was very cooperative, and the LP thanked me for being so. My parents were called and had to come get me, and police came and searched me and sent me with my parents. I had a knife (BAD MISTAKE. I forgot it was in my pocket and i had no intent to use it EVER. And i let them know and they trusted me.) But they wrote me a criminal citation. i was charged with "Theft 2nd Degree" and "Possession of a Theft Device". Im supposed to get mail with a court date.
My question is; How will the court work? And what consequences will there be (fine, jail time, community service...)?
And how can i explain the knife situation? I really forgot it was in my pocket cause i was with friends earlier and i was showing it off :/

Get a lawyer. At 17 they very well could consider you an adult. 2nd Degree theft and the burglary tool are bothclass A misdemeanors.
Class A is good for a rear in jail and $6250 in fines.
One option in Oregon is a civil compromise which might get the charges dismissed when you pay the restitution to the merchant.

It is my first time in trouble with the law. And the officer repeated the fact that i was still a minor. Now i know that the 1 year and 6250$ fine is a possibility, but that is the Maximum of what they can give me and is probably not gonna happen. What is PROBABLY going to happen. Im guessing community service and fines, and probation.

Getting an attorney is still something to consider...there can be lifelong repercussions should you be convicted of a Class A Misdemeanor. An attorney can help you with your options negotiate & advocate for you.
