Terminated, With Questionable Conduct by a Co-Worker
My question involves labor and employment law for the state of: Utah
Here is my situation. I was terminated on Friday. One day three or so weeks ago while at work, one of my coworkers who is married to one of the owners/partners of the small company during a conversation about straight razors started asking me about shaving my genital region. This made me uncomfortable and I tried to change the subject and get out of the topic/conversation. I didn’t want to lose my job so I kept it to myself and was uncomfortable at work because of that conversation. Fast forward to Friday, after I was terminated and was walking out with my stuff, the same guy starts approaching me and tries to instigate a fight with me. He proceeds to tell me that he would physically harm me and that we should “take it outside” to fight. This is a small company who is owned by a group (one of the partners is the brother of the guy) who also owns other companies or business ventures. They have also been dishonest with me regarding my pay and commissions and have been misleading the people they try to sell to. What should I do?
Re: Would I Be Able to Seek a Claim
What reason were you given for your termination?
Re: Would I Be Able to Seek a Claim
They claimed that I was inflating my number of dials each day by purposefully dialing the same numbers over and over. They also claimed that I was saying inappropriate things which I have no memory of doing since I am very careful about what I say at work. They were looking to get rid of me because my numbers were down. And since Utah is an "At Will" employment state, they can terminate you for any reason. I'm furious as they never spoke with me individually about any of this before and I deny their accusations.
Re: Would I Be Able to Seek a Claim
What kind of claim are you asking about? I'm sure you have a valid claim to collect UI but I suspect that's not what you're asking. Do you think there was something illegal about your termination? If so, what?
Re: Would I Be Able to Seek a Claim
A harassment claim and I feel like I was unfairly targeted for termination because I am a male.
Re: Would I Be Able to Seek a Claim
On the basis of what you have posted, no, you do not have a harassment claim. Nor have you provided any evidence that you were targeted for termination because of your gender.
Do you have other evidence that you have not posted?
Re: Would I Be Able to Seek a Claim
Well it is a very casual office environment and a coworker was in on the conversation.
Re: Would I Be Able to Seek a Claim
That does not change anything. Any other evidence?
Re: Would I Be Able to Seek a Claim
Give me an idea of a good starting point. What kind of evidence are you looking for. I'm not sure where to start as I am new to this.
Re: Would I Be Able to Seek a Claim
OP, have you spent any time researching this subject? We honestly cannot hold your hand through the whole process and question of what is or isn't evidence; you have to be willing to spend some time educating yourself, too.
Have you tried Google?
