Wage Garnishment in How It Applies to Bankruptcy
My question involves bankruptcy in the state of: CA
How does salaried income factor in when filing BK?
In other words, is there an example or is it common of wages being garnished to pay part of BK?
I presume it is for a Chapter 13, but does Chapter 7 avoid this case?
(I suppose this question might be a bit open ended, let me know if you need more details)
Re: Wage Garnishment in How It Applies to Bankruptcy
Your income affects whether you qualify for Chapter 7, and your discretionary income affects how much you must repay under Chapter 13.
Re: Wage Garnishment in How It Applies to Bankruptcy
Thanks for your reply.
Would you be able to provide an example of the differences between Chapter 7 or 13 on how wages can be garnished, if they can be garnished?
for example, $1 for every $100 in gross wages if you owed X amount.
Is there anything like that, that happens in Bankcruptcy court?
Or is my concern for wage garnishment, misguided when filing for BK and I shouldn't have to worry about it?
