Can I Be Emancipated

My question involves juvenile law in the State of: Hi, I am wondering if I can be emancipated.
I am 16 years old. I do not have a job, yet, but I do have money, enough for 2 months rent, I also have people who would let me live with them for a very low rent also. First let me tell you about myself.

I was "adopted" at 7 years old, after many years of being abused sexually and mentally. The family that adopted only adopted me because they wouldnt have been allowed to adopt the new born if they didnt adopt me(they told me this). My caseworker told me that if I didnt agree to the adoption that I would never be wanted. So this family adopted me and changed my name and etc.
these past two years my godmother was arrested because she was a teacher and she was smoking weed on campus. Her boyfriend who was the Principle and still is reported her. She was abusing other stuff too. My adoptive family had me take her curfew calls and pretend i was her. Well the principle raped me twice and I hated them for making me go over there. I reported the rape but my parents said they wouldnt support me on it, because they had to protect my godmother.
My adoptive mom has been homeschooling me for a while. One day She got angry and threw a fan at me so i left. She told the cops i pulled her to the ground, she had no marks or bruises but i did and i had people who were backing me up. I did not pull her to the ground she weighs close to 200 pounds and at that time i barely weighed 100. i dont really see how that is possible. The cops would not listen to me.
then later that year ( this past summer ) my adopted parents had me teaching my little sister( 9yrs old) history and she had to memorize these timeline cards. Well she was having a hard time that day and she didnt memorize her 8 cards. so they told me to leave. I left and they called the cops. The cops brought me back and then took me to CPS who told me that i was never adopted i was just under guardianship of them. I was in foster care for about a week and then sent back. things keep getting worse. I have enough credits to graduate from highschool, and i have over 600 hours of service work. I keep the house. My chores are Laundry, cooking all meals, sweeping, mopping, dusting, and i teach piano. I have tons of letters of recommendations. i am very mature for my age, no one believes that i am 16, they think im older. I have been accepted into Pace University and many other universities. But I just want to get out and get on with my life. Would I be able to be Emancipated? oh im in texas. Help please. also i have medicaid until im 21. Will my medicaid be taken if i get emancipated? ASAP!

Then, no, emancipation is not possible. You'd need to show the court that you have a TRACK RECORD of earning enough to completely support yourself - what at the same time making good grades in school and staying out of all forms of trouble.

No. Emancipation means that you are capable of paying the going market rate for rent in your area. If you are dependent on someone else to cut you a break, and those people move, die, or get pissed off at you, you need to show the court that you could pay what everyone else in your area pays and still make it.

Unless you meet the requirements above, none of the rest matters.

You need (1) a history of producing a source of income (at LEAST 6 months worth), and (2) the amount of that income needs to cover the going market rate for rent, utilities, food, clothing, transportation, health insurance, etc.

And then it also depends on whether your unnamed state even has a provision that would allow for emancipation. And it's NOT an "ASAP" process. It'll take a couple of months to even get on the court calendar. Then time for the court to order psych evaluations, check out earning situation, schedule parents, guardians, teachers, or others to testify or be interviewed. It's anything BUT a fast process.

I inherited money $500 when my grandma died. Also i teach piano and am a nanny on the weekends.
i live in texas.

also, I can pay for utilities and rent.. i have looked at apartments and the rate is $900 with utilities.

will i be able to keep my medicaid

What part of "proven track record" is escaping your grasp, here?

In Texas, you already need to be living completely apart from your parents, and you need to already be supporting yourself 100% before you can even think of petitioning for emancipation. You typically need to be 100% on your own for 6 months to a year before you can file.

Why should you keep your medicaid?

You're claiming that you should be looked at as a legal adult who is fully capable of managing her own affairs. So why should the taxpayers shell out for your insurance?

im not saying i want to keep my medicaid. frankly medicaid is no help. im just asking because if i dont i need to find a insurance company as soon as possible.

You have a proven track record of earning an amount sufficient to cover full rent, utilities, health insurance, groceries, transportation, etc.??? Money that you yourself earned at a job that lasted at least 6 months? Once you get ANOTHER job, and have made that much, and have held it for 6 months, come back. If you're currently unemployed, there's no reason to go any further than that. No, odd jobs and piano lessons here and there won't cut it with the court.

No, you don't. You still live with your parents and you don't have a job.

One more time: Texas law requires that you ALREADY be living on your own, paying market rate rent and utilities, paying for all of your own expenses, without any help from anyone, for 6 months to a year. You cannot even file a petition for emancipation until you meet these criteria.

i called a lawyer and they said i can be emancipated. thank you for the help.
