    Habeas Corpus for a Homicide Case
    Hello,

    My fiance has been wrongfully convicted of first degree murder and is 18 years into a 34yrs to life sentence. He appealed his conviction to the level of the state supreme court - which was denied in 1992.

    We have found a pathologist who is currently reviewing the Autopsy report. I believe this will uncover new evidence.

    As a result of this can a writ of Habeas corpus be carried out by my fiance pro per?
    He is in California.

    It's been done by prisoners for decades and decades. Whether or not he has the capability is another question.

    Which court should he file the writ? (Los Angeles)

    And do you know of any books on Habeas Corpus petitions?

    Well...........Whether he has the capability or not is another question.......at least he has a lifetime to try and refine it.
