    Pulled Over For Burning Out
    i'll start off by saying i'm 16 years of age.
    some of you may/may not know of the woodward dream cruise in michigan.
    it's a yearly event where many classic/nice cars go to have fun and see all kinds of new/old things....

    i believe a couple thousand cops patrol this event each year.
    they give many many tickets out for many reasons and make lots of money off of it.
    I was crusing woodward ave. for a few hours and saw many nice cars and many interesting things.

    many people like to burnout and revv their engines...

    well i saw MANY people burning out and some cops let it go...

    i decided to do one and i got pulled over.

    it was my first time being pulled over and my first ticket.

    the cop wrote it for careless driving.

    i'm wondering if i made a court date does anyone think i have any grounds to possibly challange and win if i were to take it to court?

    uhhhh well i've never even had a warning and never been pulled over before and being that i was at an event where many many people were doing burnouts and not being pulled over and i did, i feel as though i should have recieved a warning or smaller traffic violation rather than the careless driving ticket i recieved...

    Michigan code states:

    257.626b Careless or negligent operation of vehicle as civil infraction.

    Sec. 626b.

    A person who operates a vehicle upon a highway or a frozen public lake, stream, or pond or other place open to the general public including an area designated for the parking of vehicles in a careless or negligent manner likely to endanger any person or property, but without wantonness or recklessness, is responsible for a civil infraction.
    Others doing it and not being sited for it, still does not make the ticket invalid. Nor does the fact that you have never been pulled over before.

    There isn't a rule that you get a warning before actually receiving a ticket.

    However, if you feel you can fight it, perhaps you should consult with an attorney and see what they may be able to do for you.

    well if i were to schedule a court date do you have any idea around how much that would run me? also do you think there's ANY possability of the ticket at least being reduced?

    I don't know what it will cost.

    I am not from Michigan, but there are several others on the board that are.

    I will suggest you go to the court house and observe how some of the cases are handled.

    Getting a ticket reduced does happen. No one can say for sure what your particular outcome will be.

    But, you're only 16! Which means you've been driving for MONTHS without a citation! Wow!

    If you had been driving for 20 years without a citation and a cop pulled you over for "burning out", your record still wouldn't do you much good -- careless driving (and you could have been cited for reckless driving) is a fairly serious infraction.

    In any case, an attorney may be able to negotiate a lower fine or even get the charge reduced to something that not going to cause your insurance rates to soar (and, believe me, the increase in your insurance rates will be MUCH more than the ticket). However much you pay the attorney, you will, most likely, be money ahead in the long run.

    I agree with the other posts. You may receive traffic school or student probation is what we actually use here but each State is different--bottom line is you want to see if you can negotiate a deal that hurts you the least--doesn't sound like you have a defense--I'd advise contacting an attorney to do the negotiating.
