    Lease Expires, What Happens Now
    My question involves landlord-tenant law in the State of: California.

    We are renting a house with a fixed-term lease. The lease expires at the end of the month. What happens after this date? Do we have to be out by then? Do we need to give the landlord notice if we are still going to remain in the home or does the landlord have to give us notice? If so, how much notice? What if we pay February rent does that automatically renew the lease for the entire term or does that make it a month to month lease? If it becomes a month to month lease how much notice do we have to give before moving out? So many questions.:confused:

    Landlord has been very picky throughout the rental agreement so we want to make sure that we do everything by the book here so we are not unpleasantly surprised. We are currently looking for a new place and would like to be out by the end of the lease but are preparing should that not be the case. Any help would be greatly appreciated.

    I have no access to your lease and thus I cannot comment on what happens at the end of the initial lease term or whether you're required to give notice if you intend to move at that time in order to avoid its renewal or extension on a month-to-month basis. Read your lease and then tell us what it says.

    Under the terms of the tenancy section, it doesn't say anything. It only says if we vacate prior to the end of the lease, we will be liable...Nothing about renewing. We renewed the lease once already but the landlord had sent us a new lease which we signed and agreed to. However, given that we have had our disagreements since then, we are working under the assumption that we will mutually agree not to renew the lease a third time. That's the reason why we are a little concerned. In the absence of any additional terms regarding the renewal of the lease, what laws will take effect? We just want to make sure we have enough time to find a place without being put in an awkward situation. Thanks in advance for your help!!
