2 State Jail Felonies and a Second Degree Felony
My question involves criminal law for the state of: Texas
Here's a little background: I'm an 18 year old male in the state of Texas...
I have two prior arrests for possession of marijuana Class B, and possession of marijuana in a drug free zone Class A. I got a deferred sentence for the first one, and completed probation without a problem. For the second one, I haven't even gone to court yet, I am on "Conditions of Release" but on November 1st, I violated by failing a UA for marijuana. I spent 16 days in the detention center, and was released and my court date was set for January 19.
On December 3rd,I was arrested again on a 2nd degree robbery charge, Credit card abuse, and forgery of a check, for luring a man into an alley way and threatening him, running his pockets, and stealing his bike, wallet with $70 in it, and all of his credit cards. I ended up using his cards to buy some things, about $300 worth of stuff. My bond was set at 10,000, but we only had to give $1000. I'm just trying to get an estimate on how much time I'll get for these charges. Here's an overview of what I'm facing:
1. State jail felony- Credit Card Abuse
2. State jail felony- Forgery of a check
3. 2nd degree robbery
4. Class A P.O.M in a DFZ

The best person to advise you is your lawyer, based upon your actual conviction charges or plea bargain.
You can look at the statutes governing sentencing, Penal Code, Title 3, Chapter 12.

I think you can expect to have close to a max sentence. Your escalating illegal behavior is the equivalent of thumbing your nose at the court and legal system.

It depends what plea can be arranged and on the judge or da.

If the victim can ID TheDUDE as the suspect in the robbery, and video surveillance of the transactions with the credit cards can confirm the victims statement, I don't see why the State would give a plea deal.
A robbery charge in Texas carries a range of punishment. Between two and twenty years in prison and up to a $10,000 fine. I think with TheDUDE's track record and that he now has a violent felony charge, that the State will not offer a plea bargain and sentence the maximum by law.
Good Luck with your incarceration, and hopefully this time they can rehabilitate you, because so far it hasn't worked.

The plea might be harsh,chance are if he goes to trail the sentence will be even worse . Maybe they will give you one more shot b.c of your age but your gonna be spending a good amount time behind bars. Kid your still young stop doing screwed up shit,I think on the next offense they can even sentenced u to 99 years in prison Texas is very strict. I'm not about throwing people in jail but for what you done it's justified. Besides being morally wrong,people don't even carry much on them. The penalty can easily be,5,10 or more years in jail.
