How do you go to 18 hours traffic school in California
I am in california: Alamedia County
My question is for my mother (really).
She got pull over for "swerving" on the freeway by the CHP at 2 am in the morning (she works nights and was not drunk). She was ticketed for turning when unsafe (she was not turning or making a lane change the officer use the word serving). Needless to say it is a bum rap, she is considering goint to court, but want to consider all options.
I know most of the options about going to court so that is not the question.
Well she has gone to school already about a year ago, but I have heard about going to this 18 hours school. Does anyone know the law behind it? And what does she have to do to get it? And does one knows about how much does it cost?

If she has been to Traffic School within the last 18 months, then that is not an option for her. If she goes to court, and the officer has her driving on video, then it's basically a lost cause. She may as well pay the fine and take the insurance increase.

It is an 8 hour school and she can ask the judge to grant her permission. This is the only way.

So she has to go infront of a judge and ask for school even though she had school within 18 months. Do you know the law that allows this?
Is school something like if a Judge orders school your record will be clear. But the catcher is that Judges don't always grant school if you have been to school already with in the last 18 months.

That is why she has to go in front of the judge either way because she has already been to TVS within the last 18 mos. So I guess she will have to start working on her case or maybe even get an attorney. As was stated if there was a video but that will prove her guilt. People who work shifts that let them out late at night run into this problem all the time because the CHP are looking for drunks just leaving the bars after they close, they learn after being stoped a few times to drive better.

I'm almost positive that the California Highway Patrol does not have video equipment.

Unless they are part of an interdiction detail (which have been essentially shut down) most CHP vehicles do not have video.

FYI, the court CAN allow for a person to attend a special traffic school (usually 12 hours, but 18 hours works, too) even after prior attendance of the 8-hour school.
Traffic School Attendance
41501. (a) The court may order a continuance of a proceeding against a person, who receives a notice to appear in court for a violation of any statute relating to the safe operation of a vehicle, in consideration for attendance at a licensed school for traffic violators, a licensed driving school, or any other court-approved program of driving instruction, and, after that attendance and pursuant to Section 1803.5 or 42005, the court may dismiss the complaint under the following conditions: .
(1) If the offense is alleged to have been committed within 12 months of another offense that was dismissed under this section, the court may order the continuance and, after the attendance, dismiss the complaint. The court may order attendance at a licensed school for traffic violators that offers a program of at least 12 hours of instruction.
(2) If the offense is not alleged to have occurred within 18 months of another offense that was dismissed under this section, the court may order the continuance and, after the attendance, dismiss the complaint if the attendance is at any of the types of schools or programs that the court directed pursuant to Section 42005 at the time of ordering the continuance.
(b) This section shall become operative on September 20, 2005.

To request this 12 hours school. Can a clerk normally approve this or do you have to go to a judge? If a judge, do you request it at arraigment or before or during trial?
