    My question involves criminal law for the state of: NY

    Hello. I am a college student from Stony Brook University charged with Petit Larceny for clothing at a JC Penny totaling $72.00. This is a first offense. I have not told my parents and I do not want to burden them with the issue of my foolishness. I'm relatively sure I have enough money to deal with fines on my own.

    The issue I am most worried about is whether or not I can get a lawyer for free. My parents are in the process of getting divorced and my mother has never paid for any of my education, It all comes from my father working overtime and such. I am 20 years old. What are the implications of these things on what I'm likely to be sentenced with and in terms of whether or not I can get help from a public defender? I suspect in all likelihood a lawyer would be the most expensive part of all of this...

    You are an adult, only your income will be considered when qualifying for a public defender. If this is your first offense and things work well, you can possibly get an ACD which is the best bet as it will avoid (if you don't screw it up) a lasting criminal record.

    PS: A public defender is NOT free. Usually a couple hundred.

    It depends which court,some do charge a fee,I had a public defender in ny and didn't have to pay them anything. Either way a pd is a lot cheapier,plead not guitly and ask for a pd. Then tell u want to get an acd,see if that can arranged. Another option is a reduction to disorderly conduct which is a non criminal volation,an acd is the better result .
