    Landlord Changes Move in Date After Lease Has Been Signed
    My question involves landlord-tenant law in the State of: Kentucky

    I recently signed a lease on an apartment that I had already placed a deposit on. At the time of the lease signing I paid a pro-rated rent from the scheduled move in day until the end of the month. After signing the lease a representative of the Landlord later informed me that they would not be able to honor the move in date on the lease because they were in the eviction process with the previous tenant. The representative verbally gave me a later move in date but as that date approaches they are backing away from that as well.

    The wording in the contract says that the Landlord has 30 days from the move in date to deliver possession to the Resident otherwise the lease can be cancelled without further obligation. There is also a line in there about how the Landlord can not be held liable for damages if the apartment cannot be delivered on the agreed date.

    So my questions is, do I have to sit here in limbo until 30 days have passed to get out of this lease?

    From what you have told us so far, yes.

    You are, of course, able to contact the landlord and attempt to negotiate a resolution; I cannot promise that he'll be receptive.
