Preparing a "Request for Admissions"
My question involves a child custody case from the State of: Florida
My ex served me with "Petition to Establish Paternity and for Related Relief" and 6 hours later, I gave birth to our son. He was at the hospital and signed the birth certificate. I filed my answer and counterpetition, and that is where we currently are. We have our first Case Management Conference in February 2012. I am currently preparing a "Request for Admissions."
My questions regarding "Request for Admissions" are:
Can I file it with the courts even though we haven't been to our Case Mngmt hearing yet?
He, his brother and mother (very close family) all use smoke marijuana together, can I include this topic in one of my questions?
I have read somewhere that you need to get certain things "authenticated", I have arrest records, would that apply? How do I go about getting things authenticated?
Are there certain questions/topics off limits?

You normally just file a notice with the court noting that admissions have been served upon the opposing party .. you dont file the actual requests with the court. You can ask the opposing party to agree that the records are accurate (they may not agree, but they cannot deny something that they should admit). Arrest records? These are public records ~ do a FOIA request & then you have admissible evidence with that.
