Pending Marriage and AOS

Question - I met my boyfriend in October while on vacation in the Turks and Caicos Islands. He came to visit me last week (he already has a tourist visa) and we talked about getting married. We discussed me moving there or him moving here. He would like me to move there but due to my job, I want to stay in the US so he has agreed once we are married. So my question is, can we get married here in the US? Can we file an AOS while he has 6 months to legally be here in the US to start the process or will he need to go back and we wait the time for the AOS to process? I read something about an unwritten 30/60 rule. I just want to ensure we are doing everything correctly. We aren't really focused on WHEN we get married, we just know we want to and we want to do it the right way ....legally and properly to avoid any problems.

If he enters as a tourist and quickly marries, you run the risk that the USCIS will determine his entry as a tourist to have been fraudulent. If you marry and he returns home before going out of status, that's not an issue - but if he reenters with the intent to immigrate he should do so on a spouse visa, not a tourist visa. If you decide to marry and have him stay in the country while you petition to adjust his status, he should stay in the U.S. unless he's granted advance parole for any out-of-country travel.
