    Motion for Change of Venue
    My question involves a child custody case from the State of: Indiana. I was served papers from a local attorney for a verified emergency petition for appointment of guardian over minor child. I'm a single father who is still legally married and have had my child since she was five months old. I entrusted my daughter to a very good friend and she gave my child over to a couple who hired the attorney. I learned from a local attorney that because of who was the judge and the attorney that I needed to file for a change of venue and have started the typing. I just want to make sure that I cover all my bases. Thanks in advance.

    You should hire a lawyer. Seriously.

    We have no facts that would indicate whether a change of venue is appropriate or possible in your case.

    I wish I could hire a lawyer, but at $1000 for the retainer and no assets, I'm stuck. The local lawer I talked to today said the I need to file for change of judge because of his record siding with the attorneys

    Not liking the judge isn't a basis for a motion to change venue. What is the legal basis for your petition to change venue?

    according to the local, he has a record of being the favorite with my opposing attorney and that he 80% of the time rules in the favor of said attorney

    I'm just going to go in head first and following my gut paternal instinct. I will do my best to keep everyone updated here.

    Went to the hearing and everything is looking up. I used my right to a continuance so that I can acquire legal counsel. The attorney objected, and the judge denied her objection. So in all it was a good day. I like the judge, so I've learned not to jump to conclusions. Now I have to file a petition so I can take my daughter to a Dr.'s appointment. Yes I have consulted with legal counsel and will hire him as soon as funds are available.
