    Expunging an Adjourned Class A Misdemeanor
    A little over three years ago in Denton County Texas I recieve defered Adj. for a Class A misd. of assualt-cause bodily injury. 18months. What I would like to do is take the steps to do what I need so that prospective employers cannot pull this up or see it when I apply. Thanks

    Expungement/pardon

    There are several thousand questions on this forum similar to yours. Thus, I have prepared a standard answer.

    Standard answer: Expungement is generally granted for illegal arrests or unlawful convictions. Generally, pardon mean you are forgiven for the crime but it remains on your record.

    The usefulness or effectiveness of either procedure is generally worthless.

    Check with the governor or attorney general of your state to see how you can go about either of these procedures. Check with the Attorney General or the President for federal expungement or pardon.

    You must remember that there may be private background check companies that have past offenses on their databases; those reports will never be expunged.

    No offense SeniorJudge, but you are pretty much off base as these relate to Texas.

    The process for both is quite effective as long as you follow through and also notify the private entities once you record has been sealed or expunged.

    Expungements are only available for acquittals, dismissals, and Class C Misdemeanor deferred adjudications. Your record is actually destoyed. Non-Dislosures (sealed records) are available for most other deferred adjudications. It isn't quite as good as an expungement as there are some exceptions that allow some entities (such as hospitals and schools) in additionto state agencies to view your records. However, it is effective for most employers.

    Regardless, the order will only be sent to state entites by the court. Although it is effective against all of those private reporting companies, it is up to you to send them a copy of the order and make sure they remove your records.
