Re: Loan Refinanancing Fraud
You posted this as a forgery issue. Are you stating that he forged your name on documents? If not, please explain what this has to do with forgery.
The loan modification happened how long ago? You learned of it how long ago? Your divorce judgment was entered how long ago?
Re: Loan Refinanancing Fraud
The divorce was in 2003. The house was on both names. The loan was on his name. The loan was a 30 year loan since 2002. By 2011 we have had 8 years of payments. We had a marital agreement in November 2010 that all of the past due payments will be made half by me and half by him. He refuses to follow the agreement and make any payments and the house goes into the foreclosure in December, 2010. Then he tells me that the payments have gone down drastically. Turns out he modified the loan without my consent or knowledge. I got a copy of the loan modification and it is 35 extra years. He wouldn't give me an authorization to speak with the loan company until after the modification. Modification was in June, he signed the authorization in July. I am the owner and
It is fraud because he modified the loan on my property without my consent.
The loan company was aware that there are 2 owners, but they never asked for my consent or signature on loan modification.
So, the fraud is that he made the modification without my knowledge or consent, made the loan by $20,000.00 larger (added to the end), canceled the authorization now so I cannot have any access to speak to the loan company. We also had an insurance claim after Katrina and the $53,000.00 that the insurance gave us, went to the escrow account at the loan company. He took all the money and did not give me anything to make any repairs.
