Child Support Sweeps and Warrant Limitations
My question involves child support in the State of: New Jersey
I am involved in a child support case of questionable paternity. With that being said I keep in touch with the Sheriff's office of the warrant issuing county (monmouth) and the county I reside in (burlington). For a few months I have been out of state and have kept them updated as to my whereabouts and told them when i returned i would turn myself in to resolve the matter. I recieved a phone call from home today saying the County Sheriffs came to my house this morning and was allowed in to search for me and of course, I was not there, but in the course of the search and after they upset my girlfriend with accusations of me fleeing the house and threatened her that if they found out I was there she would pay for it. Do the Sheriff's who go out have any contact with the person answering the phones in the daytime? Is there a log kept in on who calls the child support unit and why? I understand you would come, especially if it was a sweep which I believe it was but shouldn't they have known there was a high possiblility i would no tbe there as I have told their offices I was not around? Also, if they came for child support, did they just have a bench/arrest warrant or a search warrant? If they just have a bench/arrest warrant, will they keep going back to my house looking for me and giving my girlfriend more panic attacks and are allowed to kick in door or break window to gain entrance and then have to shoot my 2 Cane Corsos who will undeniably attack them as intruders and ransack my house looking for a person who has constantly told them I am out of state and will turn myself in and soon as i go home, or will she be able to tell them she will not let them in since they do not have a search warrant, and if she does that, how long will it take for them to get one and for the above scenario to take place? I have tried to be polite and cordial with the authorities my entire adult life and din't have to go through all this when I had actual crimianl warrants out that landed me in prison, but child support from a child I never knew about until my first arrest for arrears is causing me a lot more harm than good and I want to understand what can they actually do with the warrant they have and will my home be safe from the Sheriffs until I get back?
Re: Child Support Sweeps and Warrant Limitations
You seriously need an attorney.
There's either far more to the story than you're telling us, or things are so messed up that it goes beyond the scope of a message board.
Re: Child Support Sweeps and Warrant Limitations
Thank you. But it's simply a warrant for non-payment but I have just been trying to distinguish between a bench warrant and search warrant and my girlfriend does not like police coming in the house touching her things and my dogs are very protective so i want to know if she has the option to tell them no because when i get back hopefully i turn myself in and tell them i need another court date to establish paternity because this case is full of nonsense to me. but the story is simple, non support warrant and what can they do with it.
