Communication of Threats, After I Was Assaulted
My question involves criminal law for the state of: NC
I was assauted by a male roommate (college not personal) and I have medical proof of it. However, he had my landlord call the police to escort him from the premises by playing a tape recording of an alleged threat he accuses me of saying to him. He taped it and played it over the telephone to the landlord and the police. I am now waiting for a summons to appear in court. He made this allegation AFTER I told police he assautled me. Is a tape recording allowed in a summons case, and does he have a case, although he assutled me. I am a thirty years his senior, and a female,. He is an disabled vet, age 28, and male.

Medical proof that your roommate assaulted you?
Or medical proof that you were assaulted?
Did you actually threaten him? How was the recording obtained?

I have medical proof that he assaulted me. No I did not threaten him. He made the tape from a tape recorder in his room. He played it over the telephone to the landlord. and later to the police.

I hate to be pedantic, but please explain.
"Medical proof" that he assaulted you?
There was a medical professional present when you were assaulted? Or, you were assaulted and there are medical reports?
These are two very different things.

I was first examined by a medic and proof of assult was documented, then I was taken to emergency for tests, and was diganosed with contours to my head, face, and mouth. Where do I stand. Is this enough evidence . Does a tape like this stand up or allowed in court.,
