Can I Get Emancipated and What Are the Legal Steps if So
My question involves juvenile law in the State of: Oklahoma.
First off, I was removed from my mother's home in February of 2011 due to her common and consistent uses of physical abuse, alcohol, and meth. I have lived with my father, his wife and their seven children since then, in their four bedroom house. I am the oldest of eight here. For almost a year, I have worked towards emancipation by finding a job that pays high enough for me to support myself. I now make about $1,200 a month, which is more than enough for me to rent a one-bedroom apartment for myself. Because I have had a job since before I turned sixteen, because I am currently a student at Tulsa Technology Center, as well as enrolled in high school, and because I have always taken care of myself, I believe that I can proceed with the emancipation process. I only need to know where to start. My father, who supports my decisions, will allow me to go through with this as long as I take care of everything myself. Where do I go from here?

Read this.
Emancipation is not going to be of much help. You can move out with parental permission, although we don't know enough of the legal background to say what will happen if dad says "yes" and mom says "no".
Re: Can I Get Emancipated and What Are the Legal Steps if So
I know that I can move out with parental permission but my father will not allow me to leave unless I am emancipated by the court. After the protective order was issued against my mom in February, I think she lost any guardianship rights she had over me. I could definitely be wrong, but I highly doubt that my mom would oppose to this, considering all the child support she owes and can't afford. I'm not a hormonal, spoiled little thing, at least not consistently, and I have no desire to live with my boyfriend. I prefer to be without a roommate as well.
Re: Can I Get Emancipated and What Are the Legal Steps if So
In Oklahoma, an emancipated minor can do exactly one thing that a non-emancipated minor can do, and that is own property. If your father will not allow you to move out unless a court emancipates you, then I guess you're not moving out.
Re: Can I Get Emancipated and What Are the Legal Steps if So
You are free to petition for emancipation with the court. As you now know, that will do nothing more than allow you to enter into contracts. If that's what it takes to get dad to let you move out, though, that's what it takes. The issue of mom's consent remains.
" I'm not a hormonal, spoiled little thing, at least not consistently" - I like that. We're all "hormonal, spoiled little things" at least some of the time. It's part of being human. ;)

He will let me move out if the court finds that I am worthy of emancipation. They say yes? He signs off. Are you going to be helpful or try to deter me? You're not doing a swell job of either.
Thank you, Mr. Knowitall. Now, to petition with the court? Can you explain that a little bit? And is it absolutely necessary to hire a lawyer?

Have you read about emancipation in your state, Gretchen?

Are you trying to be bratty? Because that statement was a swell example of brattiness.

That wasn't towards you. It's difficult to use this on my phone. There was no reason for cbg? to post unless they planned to be helpful. That comment was not at all helpful.
