Contempt and Warrant Enforcement in 2 States
My question involves child support in the State of: TN/CA
If the original support order is in TN and remains there, the person moved to CA. The state of CA has been asked to enforce collection and contempt for non-payment. Can TN still issue a warrant? If the person is to be known to be visiting the state of TN can that warrant be acted upon? Does the fact CA was asked to enforce, pass all action over to CA? Just wondering if the new state now has all control and the home state just waits on the new one to act. Thanks
Re: Contempt and Warrant Enforcement in 2 States
If somebody is not compliant with a Tennessee court order, the court that issued that order can take steps to enforce its order. What will happen in this specific case depends on the facts, the practices and policies of the court and prosecutor that would be involved, and whether the payee is willing to seek private enforcement in the event that the prosecutor is not willing to act (and whether the law, court policies, and facts that we don't know would allow for private enforcement).
