Statutory Rape in Florida
My question involves criminal law for the state of: Florida.

I have recently have come to know of a friend in whom has been incarcerated and has been so for two months. He is a young man of twenty-one years of age and is awaiting trial. The crime he has allegedly committed pertains to the statutory rape of a 15 year-old in which he denies. He has admitted to have only had oral contact (kissing on lips) and "feeling her up" while clothes were on, but had never penetrated her in anyway. However, there are several factors that need mentioning. A.) He may or may not have been told she was of age. B.) The mother of the daughter (43 years of age) provided alcohol to her daughter, the 21 year old and, the "boyfriend" of the mother who is 24-years old. C.) All four became intoxicated during this event. Mother and "boyfriend" left 15 and 21 year old alone to pursue other intimate endeavors. D.) A report of statutory rape had not be filed until roughly four months after the incident. E.) The only criminal history the 21-year has is one DUI. F.) The girl has been reported to have had promiscuous relationships with older men before and may have a drug history. If my friend has a decent attorney, what is the likelihood of his going to prison/not being incriminated for the crime in the state of Florida? Any other advice or help would be greatly obliged. A) That was his responsibility. He's the adult.
B) Not relevant to HIS case, but may be an issue in and of itself.
C) Not relevant to his case, again.
D) Within the time limits.
E) Not relevant.
F) ..well, Florida is probably the strictest state in the entire country when it comes to underage sex and the enforcement of the various laws pertaining to unlawful conduct with a minor.
Nobody here can guess or predict what a judge may rule.
Your "friend" needs to speak with his attorney and ONLY his attorney about this matter. If this is truly your friend and not yourself, you're doing him no favors by broadcasting the situation online.
