Changing My Child's Last Name to Mine, While Father is in Jail
My question involves name change laws in the State of: Florida
I am not sure how or if I can change my daughter's name to mine. Her father has been in and out of jail for the last couple of years. In between I was letting her visit him at his parents home. But now that he is back in Jail and will be there for a while i believe, I have no plans of letting him see her again. I would like to change her last name and if possible terminate his rights while he is away. One day I hope to have my current boyfriend (we do plan on marrying one day) to adopt her so we can all share his last name together. But I need help and don't have alot of money to do this. Any help that can be given will be appreciated!! thank you!

If you can get the father to consent to a name change, it's pretty easy. If not, he'll be allowed to oppose the name change and, should he do that, you'll have to prove that the name change is in the child's best interest. Name change forms can be found here.
If you plan on getting married and eventually initiating stepparent adoption proceedings, and anticipate having grounds to involuntarily terminate the father's rights at that time, perhaps you should be prioritizing that avenue over having the child's name changed now and again in a year or two.
