Ex Wants Sole Legal and Suspend My Visits

My question involves a child custody case from the State of: NY

Me and my ex live in NYC.We have a 5 year old daughter.We both have Joint legal custody,she has violated my visits 3 times,has false accused of domestic violence,and wants to suspend my visits,and wants the court to grant her Sole legal custody so she could flight out the country to see relatives that my child doesn't even know.

So I'm not going to sign a passport when in her mind is wrong intentions,and afraid she won't come back for my visits in the summer which i have my daughter for 2 weeks

can this be prevented? would they not grant her sole legal?

When you say "falsely accused", what exactly do you mean?

Do you have DV convictions? Are there any restraining/protective orders in place?

Has she expressed that she will not return to the US?

Yea, I have a OOP against me since June 15 I'm still fighting that case.I have another court date Dec 8,2011 included the one she just file to suspend visits,be granted Sole Legal custody because to she wants to flight out the country

u asked 2 questions so i answer the first one,no I don't have proof that she actually said she will not return,but suspend my visits for no reason,and want sole legal custody so she could go ain't right,and stateing that i was diagnose with retartdation, and i know my ex gurlfreind for 6 years she ain't coming back for the whole summer!

No, that's not proof of anything other than someone trying to protect themselves (in the eyes of the court).

If you refuse to sign, Mom can go to court and the court can compel you to sign for the passport, if she's not awarded sole legal custody.

Well we have joint legal custody we did speak before when was in good term,and i told her i think about it and if im willing to let her go i will buy the passport,and she argeed,Now i get this crap from her,and how dare she now behind by back and saying all these accusation,and got the nerve for me sign

It happens with a frequency that would - evidently - surprise you. Parents can be ordered to sign for the passport. Please don't misguide the OP.

The judge cannot sign the passport app.

However, a judge can order sole legal custody - so that your signature isn't needed anyway - or, the judge can (despite what the other poster said) order you to sign.
