Property Rights of a Minor
My question involves juvenile law in the State of: Pennsylvania
I am 17 and i have a car of my own which i have been payng for ( and have documented proof from the bank) since i got it in April. It is in my mothers name only because i was not old enough to take out a loan for it, however the payments come out of my bank account. I will be turning 18 in January and i would like to move out of my house then because mine and my mother and fathers relationship is not good at all. I have all intentions of finishing high school, i would just like to be out on my own. My mother says that if i move out before i graduate that she will take my car. I make the payments and i pay for the repairs and everything. I have a good job to 0pay for it all on my own. how can she do that once im 18?
Re: Property Rights of a Minor
She can do it at any time. She does not need to wait until you are 18. What she told you was she would exercise her right as the titled owner of the vehicle to stop you from using it, if you move out before completing high school. Consider the payments and repairs, costs of using her vehicle, if you lose it, by leaving.
Re: Property Rights of a Minor
As long as she is on the title, she can do whatever she wants with that car, at any time it pleases her. Even after you turn 18.
Legally, she is the owner of the car, and will remain so until you make arrangements to have the loan and title put in your name.
