Bench Warrant for Non-Payment of Child Support
My question involves child support in the State of: Michigan. My ex did not show up to a hearing regarding his not paying child support in the last 10 months thus the judge ordered a bench warrant for his arrest. I received notification of such in the mail, as did my ex, and nothing has happened. He is laughing it off and apparently for good reason, they police have failed to pick him up and it's been a month now! What's protocol for arrest on a bench warrant for non-payment of child support in Michigan?
Re: Bench Warrant for Non-Payment of Child Support
If you're asking if they go hunt for him to make an arrest on a misdemeanor warrant....no, they probably don't. No law enforcement agency in the country has the manpower for that. Like most warrants, unless he's on the top 10 Most Wanted, the warrant gets acted upon when law enforcement happens to come across him - usually for simple, stupid, things like minor traffic accidents, traffic stops for a tail light being out, neighbors complaining because the music is too loud, etc. If you happen to know where he is at some given moment, where law enforcement can quickly locate him to make the arrest, call in with that information and if they can get to him fast enough to locate him, they can effect the arrest. But typically no, they're not out TRYING to find people with warrants (because warrants don't expire, and even if they WERE looking for wanted persons, they'd be concentrating on violent felons).
Re: Bench Warrant for Non-Payment of Child Support
If the police have the manpower and feel like going out and looking for him they may do so, but they have other priorities (like crime) and as you are probably aware most Michigan cities are under extreme budgetary constraints. If he gets pulled over on a traffic stop within the pickup radius on the warrant, he will probably be picked up at that time.
