Emancipation in Florida

My question involves guardianship in the State of: Florida

Now, my mother is an extremely scary woman. She has anger issues, though she would refuse to admit it, and tends to overreact. A lot. She's also extremely overbearing, and expects us to basically be perfect. And we usually are--both my sister, who is fourteen, and I (sixteen) take and do well in Honors and AP classes. She rarely hits us, and when she does, it doesn't leave much of a mark. But she always means everything that she says.

So, today, when I got off work at my part-time job she took me back to my dad's house to get mine and my sister's bags, since an incident occurred the night before that resulted in my sister and I getting into a lot of trouble with my parents. However, when we were about to put the bags in the trunk of her car, she opened the car door and walked up to us. She hadn't said anything to me the entire car ride until that point. She said: "I'm not ready to take you home. It's better if you stay here for now. But I'f you try to pull anything with your dad, I swear to God I will f****** kill you and go to jail." Then she went back into her car and left.

For the past six years I've always had deep emotional issues concerning my mother. We have never gotten along and our views on life and my future are completely different, and the psychological damage I believe it has caused me and my sister has taken a toll on both mine and my sister's health. I don't think I can stand going back to her house--I'm honestly a bit afraid for not only my physical, but my psychological wellbeing if I do. If we go back, I know for a fact she will take my sister and I out of our current high school, which she can do because we're only in a magnet program, and put us into the school we're zoned for. My education means everything to me, and even more so to my sister--we really want to stay in this magnet program. However, my dad's income may not prove sufficient enough to take care of both my sister and I, nor has he ever expressed any indication that it would be alright with him to move our primary residence to his house. I was wondering if I can emancipate myself from my parents and live in an apartment near my current high school, or live with a friend and their family until I can afford my own place, because right now I'm working a part-time job. And if I can, can I then have my sister live with me there?

In Florida, the parents have to file the emancipation petition.

however, it's a moot point to be honest. You have absolutely no chance at being emancipated, since you are unable to prove to the court that you are currently completely self-supporting.

Dad is free to file for a change of custody, if he can meet certain criteria. He could then file for child support from Mom. I'm sure that would help with the finances.

If you are being abused, you need to report the abuse.

I would report abuse but it doesn't seem as if psychological abuse is considered that seriously lately, and I don't want to be put in a foster home if it means I'll have to switch schools.

But is there any way to apply for a non-natural guardian?

Not a chance, unless both parents are proven legally unfit.

ROFLMAO. You are so self absorbed you do not realize what a wonderful job mom has done to raise you. No, you are not even close to being in a situation where you can get emancipated. In ten years, when you have proven how smart you can be and are beginning to enjoy success, you will realize what mom did for you, however you will swear you will never treat your kids that way. In 25 years, you will say to yourself "Oh No!!! I am just like my mom". Keep up the good work, only 2 years to go. Remember mom is only human and will make many more mistakes in those two years, however you are proof she is on the right track.
