Hit by Cab Driver with "Fleet" Insurance - Would the Cab Company be Defendant in Suit
Quick question, guys. I was rear-ended while at a complete stop by a cab driver. The driver was insured by MAIF (Maryland Automobile Insurance Fund), which is the generic insurance source in this state (Maryland) for troubled drivers, new drivers, and others who can't get auto insurance through a more reputable company.
However, the actual policyholder is not him but the Cab Company, as they maintained "fleet insurance" for the cab he was renting. In terms of any possible lawsuit that would be filed for injuries sustained, is is the Cab Company that would be liable? or the driver? Or both?

Rob, sue the cab driver and the cab company.
Let the court sort it out.
