Emancipation at 18

Okay I am 18 yrs old and my parents have been divorced for 14 yrs. My mother lives in Indiana and was issued custody of me, my older brother, and younger sister. My dad always lived in a different state, but we still visited him. He now lives in Arizona. I turned 18yrs old last August so I am almost 19 and I graduated high school June 1st 2006. About three days after I graduated my boyfriend and I moved down to Arizona to live with my dad. I had planned for a couple of months to move after graduation. Now I thought once I was 18 I would be automatically emancipated when I finished high school. Well two weeks ago my dad took my mom to court to try to get custody of my younger sister who wants to move out here also she is 4 months away from turning 18, and then we were also going to court to make sure I was emancipated, my 21 year old brother was emancipated, and to either change the amount of child support that my dad would have to owe if he didn't win and my sister didn't move with us or chnage it to where my mother had to pay for her if she moved out here. Well the judge ordered my mom custody of my sister and me and then emancipated my brother. But he said if my mother agreed I could still live with my dad in Arizona. She did agree and I came back to Arizona with my dad but he is still suppose to pay child support on me.
Questions?
Why and how should he have to pay my mom child support when I am almost 19 and live with him.

She won't emancipate me so what options do I have to do it myself?

I am enrolled in a community college and suppose to be starting on Monday if I don't start and I wait a semester will I be automatically emancipated then?

If I marry my boyfriend will I be emancipated?

Or can I take my mother to court?

Lastly can the judge in Indiana even order my mom custody of me when I haven't lived there for two months and I am almost 19.

I do have a full time job at a nursing home and currently trying to get in at hospital I am a registered CNA.

Please let me know as many options as you can and proof where I can look them up.

Age of majority in Indiana (when it comes to child support) is 21.

That isn't a good reason to get married.

This really is an issue that your father should deal with, but you could file a petition for emancipation in Indiana.

Apparently that is exactly what happened. Mother has custody, even though you are not physically living with her. So until the court orders are changed, dad continues to pay child support.

Okay but if I don't go to school is that an option to get emancipated? I had a friend find somewhere that if I was out of school for three months I could be automatically emancipated.

There's nothing "automatic" in the law.

Okay there is nothing automatic but my question is if I don't go to school will I be considered independent and be able to become emancipated?

You will be considered independent and able to become emancipated when you get a full-time job and support yourself 100%.

Can you answer me if it is a law in Indiana that your not legally emancipated until your 21? Or is it when your 18 because I am getting a lot of people telling me that the law is 18 and your emancipated so how can a judge say my mother has custody of me until I am twenty one?

I have a full time job at a nursing home with benefits and I could support myself I am just choosing to live with my father because it is easier. So what do I have to do to prove that I can support myself 100% move out and have my own place and pay rent somewhere?

You are a legal adult when you are 18, however, as I mentioned earlier, child support can be ordered until the age of 21.

The age of majority for legal adulthood, versus the conclusion of child support obligations, can be different.
