Alcohol Citation While on Probation
My question involves criminal law for the state of North Carolina.
On Thursday I had to appear in court for a underage drinking ticket I got back in September. In court on the sheet that says what I have to do it stated I am not allowed to get another ticket before February 2nd 2012. Saturday Night a friend and I were picking up a friend at a local apartment complex. While we were sitting in the parking lot minding out own buisness two ALE officers pulled up and asked what we were doing. They noticed the car smelled like alcohol. I didn't have any on me but I had to take a Breathalyzer. what can I expect to happen to me now that I have gotten a second ticket? Is this serious that I got a second ticket while I am still awaiting the first one to be cleared up.
Re: Alcohol Citation While on Probation
We weren't in court with you, but if you're trying to indicate that you received a deferral and have now violated that deferral by getting the new violation, it would make sense for you to be consulting a lawyer as you're now looking at two possible convictions. Factors such as your age, whether this is juvenile or adult court, any other crimes on your record, whether you appear to be alcoholic, and the like, can factor into the disposition. A local lawyer can walk you through things.
