You can GET a ticket for anything the officer can think of writing you for. Whether you'd loose any challenge to such a ticket in court depends on whether the officer can successfully articulate the violation versus whether you can successfully argue that no violation occurred.
If you WERE to be cited, I suspect it would be under TX transportation code, probably section 547-333:

Note that it doesn't specify that the lights can't be used during daylight hours, but DOES provide circumstances, regardless of time, of when high beams may NOT be deployed.
