    How to Prevent a Biological Father from Getting Custody or Visitation
    My question involves a child custody case from the State of: MD

    I am asking this question for my mother. my mother has full, sole legal permanent custody of my 2 cousins. cousin one is ten cousin two is seven. she has had them since cousin one was three and cousin two a few weeks old. long story short, mother of cousins was tragically murdered by husband (never proven though). mother and husband have/had very bad history with drugs police and violence. the DSS knows the husband inmy county very well. however, my mother got a protective order on him. he was calling harrasing her. now he is trying to fight for custody of my cousins. he will NEVER recieve custody, i know that for fact given his history. but visitation is an option and my mom is freaking. is there anything she can do to prevent the judge ordering visitation? their court date is approaching and she is broke so no lawyer :( he does have one though...

    I'm sorry, but your Mom might be in for a nasty shock.

    Dad's rights were never terminated, correct? Hence he has every right to get custody of his children.

    (I'm not saying that's going to happen - I'd suggest the chances are slim at best - but he DOES have a chance).

    And if he wants visitation, he'll likely get at the very least supervised visitation unless it's proven that he's a danger to the children. You need also to be VERY careful about stating that he committed murder, since there has never been a conviction.
