MIP in Arizona, Second Offense
My question involves criminal law for the state of: Arizona
This is my second MIP, (A-244.41) my first one was "dismissed" via a diversion course, though I know it isn't truly dismissed in cases like this and they can still find it in my record. I'm not sure if it actually matters (I've been told it does), but my first MIP was well over a year ago. In fact it was likely around 2 years.
I did not breathalyze, and admitted to having 6 drinks at noon (the MIP was issued at 1:30 AM). I really just want to know what the consequences are for pleading guilty and not guilty. I've been told that pleading not guilty may or may not result in a plea bargain, but I want to actually know what to expect.
Thank you for your time
Re: MIP in Arizona, Second Offense
If you plead guilty you will be convicted of the crime and sentenced accordingly. You would want to plea bargain before you plead guilty - once you plead guilty there's nothing to bargain. A local lawyer can advise you as to the policies and practices of the local courts, prosecutor and judge assigned to your case. The manner in which MIP charges are treated can vary significantly by jurisdiction.
For specifics of the charge, see this thread.
