Can You Give Up Parental Rights if the Mother Won't Date You
My question involves paternity law for the State of: MD
my brother has a almost two year old with his ex girlfriend.(paternity is estblished) she just left him after a 6 year abusive relationship and got a 1 yr. protective order. anyway, my brother is pissed because she did this and isn't talking to him blah blah blah. he says he wants to terminate his rights if she is not going to be with him. i told him he cant. only way he can is if she is married for 1 year and the husband is willing to adopt. am i right? i know VA law is like that. but he's stupid and won't listen to me

No court is going to say, "She won't do the nasty with you any more? The horror! No way we're making you pay child support!"
It sounds like your brother could use some counseling.

He can refuse to exercise his rights regarding the child until the cows come home. What he CAN'T do is simply decide he doesn't want parental RESPONSIBILITIES. In other words, the court isn't going to punish the CHILD, or take away the CHILD's right to the support of TWO parents. If mom is later in a place where some future husband wishes to adopt the child, AND the court finds this to be in the child's best interest, THEN yes, termination of his rights/responsiblities in conjunction with step-parent adoption are possible.

thank you!! i knew this but no one wants to listen to me. and just for the record... he's not paying support...yet. i'm not sure if she is going to go after him for it..

He could always do the responsible thing and file HIMSELF to establish a child support order ;)
