Part Time Contract: Do Benefit Payments Continue Past Last Day of Contract
My question involves workers compensation law for the state of: California
Hello,
I am a part time employee at an office in california. I was employed from january 2011 through the end of April 2011. At the start of April, I could no longer work due to a hand and elbow injury.
The adjuster has accepted my claim in writing. However, the office is claiming that I am not eligible for benefits since my contract ended at the end of April 2011. They say I am only eligible for benefits in the month of April, not any time thereafter.
This sounds like a bogus excuse but I need a citation for a law showing that part time workers/workers with temporary contracts are eligible for benefits even after a contract has ended. Thank you.
Re: Part Time Contract: Do Benefit Payments Continue Past Last Day of Contract
What they are saying is that as your employment was scheduled to end as of the end of April, you don't have lost wages past that date. That has no impact on your medical benefits, if you continue to require medical care.
Re: Part Time Contract: Do Benefit Payments Continue Past Last Day of Contract
The problem is I was unable to work and kept off work by a doctor's orders after april as well.
In other words, I lost the ability to earn wages at any employment even after april even though my specific position ended in april.
What I need is specific statutes or rulings to cite.
mr know it all, are you are an attorney who can cite cases and statutes or are you simply a forum member who likes to express an opinion? I don't need opinions, I need facts. Thanks.
