    What Happens on a Second Shoplifting Charge in Montana
    My question involves criminal law for the state of: montana- i was caught shoplifting from a store,and was wondering if any one know the penalities for a second offense. my first was in another state. it was a stupid thing to do my husband had just got laid off forom his job and it was mainly stuff we needed. i am scared i have a lil boy and ont want to go 2 jail. he has been with my everyday since he was born.. i cant bare to be away from him, my heart is breaking for him. i know i should of thought of that before id did what i did. i was hoping i could do classes, and community service without jail time. right now i am the only one supporting my family. i am hoping the judge will take that into consideration. iam hoping someone knows something i am scared. i have learned my lesson and it will never happen again. i don't want to loose my family over something so stupid.

    what does that mean

    i went to court and got a pd can he get jail time reduced or can i get community service and not have 2 serve jail time. I have a lil boy and don't want to leave him. i know what I did was wrong and I will never do it again. Can I talk to the defense attorny and make a deal for no jail time. please i need some advice i don't want 2 leave my son without a mom.

    He's asking what is the statute that you are charged under. Otherwise, it is too difficult to tell you of possible outcomes. You need to look at your summons and read the criminal statute you were charged under.
