Moving Out of State

My question involves a child custody case from the State of: california

Since my ex wife moved out of state a year in a half ago. We have visitation agreement for her to see on holidaays and half summers. Does she have to pay for all cost for visits. also in my order it states the u.s has juristiction of the children can I leaglly move out of state without partitioning it . I was told I did not since it does not say in the orders and the u.s has juristion.

her atm she wants to try to get the judge to change it and make me do the drive and all cost she hasnt payed child support in 6 mnths

(I'm assuming that you're the Custodial Parent and Mom has visitation - correct? How often does she see the child? How far do you currently live from Mom?)

I am she gets to see them xmas thnks giving springbreak half the summer she lives in new mexici and I live in california the orders do not say i cannot move out of state it only states the u.s has juristtion of the children it does not say i need permission to move out of state. Go back to court. Ask for

1. Right to move to the new state.
2. Ask for transporatation costs to be ....(specify exactly how you want them paid for, perhaps mom must purchase the tickets and you reimburse her for a certain % of the cost but if she is deliquent in child support, the amount is deducted from arrears instead). For the percentage, see what a reasonable roundtrip ticket costs from your current locale to mom and from the new locale to mom, you absorb any increase, mom covers the rest...just my suggestion.

I am currently on cash assistance I do not have the funds to help her pay for her cost it is not my job to make sure she gets her visits. I am just wondering if I need to go to court to move out of state if the papers do not say anything about not being able to move out of state since she moved out odf state first.

You need to notify the court and Mom.

And really - you might be in for a huge surprise with regards to having to pay transportation. That's IF you get permission to relocate. While it's true Mom left the State first, this doesn't preclude her - depending on how YOUR move will affect her visitation - from blocking the move.
