My question involves criminal law for the state of: Florida
I know an old friend who is 26 years old, he has been seeing a 15 year old girl and her mother has approved. Found out yesterday that this little girl is pregnant. Isnt that statutory rape? I personally think its horrible but i just wanna know if he can still get in trouble even if the mother is ok with it, and what if shes ok with it now and he does something to upset, can she then report it?
If she's pregnant, he's been doing a lot more than "seeing" her.
A parent cannot give permission for a crime to be committed against their child - so parental "approval" is legally meaningless and can't and won't prevent the state from nailing him to the wall (Florida is well known as one of the toughest states on sex offenders). No, it's not statutory rape - in Florida that occurs when a victim is 16 or OLDER and there is less than a 5 eyar age difference (it gets charged under F.S. 794.05). He's 26. She's under 16. He's looking at full out 2nd degree FELONY charges (under F.S. 794.01), prison time, and a lifetime on the sex offender registry, regardless of how or what her parents think. And her PARENTS could also face criminal charges - Google the term "failure to protect". The crime can be reported any time within the statute of limitations, which won't even START running until the victim turns 18, and runs for 5 years for this level of felony. The crime can be reported by ANY person - it doesn't have to be the victim or her parents. It could be other people, such as doctors or nurses, who are MANDATED, by law, to make a report to authorities due to the victim's age - or people like teachers, neighbors, or the homeless guy under a bridge .... ANY person can report the crime committed against this child.
As long as the child seeks proper medical care, it will likely be reported by Gynecologist. It still doesn't hurt to have a private citizen report it either.
This crime SHOULD be reported. Immediately.
Before OP even posts back to this thread, s/he should call the authorities and make a report. Period.
