Shoplifting incident in Kentucky
i have asked this before but i need somne real insight on what will rpobably happen the people that answerd me beforedidnt eeven tryto help me just judged me well i had an incedent at food city in pikeville ky i was wearing a hoody the day it happend and thanksgiveing was comeing up and iy was my bf birthday and we was rideing with his sister cuz we was he;ping her shop for thanksgiveing andthen we was gona go get him a cake at the mall and mmy uncle reminded me taht i needed to buy me some claritin for my allergies cuz we had just got this new cat well i was excited for his birthday and everything and im very absent minded and i got to talking to his sister you know how wemon are wen we get to talking well at some point i must have stuck my hands in my pockets and forgot about haceint the clartin in my hand cuz i didnt have a buggy so i carried wat i was going to buy and the women comes up to me and grabs me (secruity officer) and i was freaked about i thought my bf's sister was playing a joke on me cuz they tend to do that alot cuz i didnt realize wat i had done till it was too late i went same day to get me a lawyer and i called the police station like 3 times and asked them if i would go to jail because im worried to death even tho i know i didnt do it it would probaly look that way to someone eles but i went to a court date and now i have another court day for the 17th wich i go infront of a jury what is that wat do i do there so i can be prepared and yes im mad as hell at myself for not paying more attention to what i am doing the box of med was like 5 dollars and the police station said i wouldent go to jail rpobly a fine and my lawyer swore i wouldent go to jail but im scared to death i dont know weather to belive them or wat ney help wud be greatly appreciated

If I were you I would definitely get a lawyer and let him/her do all the talking in court especially if you talk the way you post is written.

Shoplifting is a Class A misdemeanor for theft of less than $300 in Kentucky.
Class A misdemeanor is punishable by a fine of up to $500 and/or a jail sentence of up to 12 months.
While it is good that you have a lawyer and hopefully it is one who has experience in shoplifting cases, no one can say for certainty what the outcome may be.
It sometimes varies from county to county, judges and the prosecuting attorneys have different ways of handling these sort of things.
Some county attorney's have requested input from merchants on what they feel the punishment should be. Most of the merchants felt that jail time was appropriate (as they want to deter theft) and extended sentences should be given to repeat offenders. The ranges that they recommended for first time offenders were 3 days to 360 days in jail.
Kentucky takes shoplifting seriously (as any state should) and it's goal is to deter people from stealing, because this reflects upon the prices that honest customers have to pay.

If the security officer grabbed you before you left the store or passed the cash register, then you hadn't actually "stolen" it yet. Whether or not you mean to commit a crime, though, if you do walk out of the store with an item it is still considered stealing. Since it was just some claritin you probably wont get much more than a slap on the wrist for it if you are convicted. The best thing if you hadn't yet left the store with it is to ask your lawyer to get the store tapes. If they show you hadn't yet commited the crime then you should be fine. My best friend had the same thing happen to her and after her lawyer got the tape it didn't even go to court.

Willful concealment of unpurchased merchandise of any store or other mercantile establishment on the premises of such store shall be prima facie evidence of an intent to deprive the owner of his property without paying the purchase price therefor.
(2) All city and county law enforcement agencies shall cause to be made a photograph, a set of fingerprints and a general descriptive report of all persons except juveniles arrested for theft through an act of shoplifting. If convicted, two (2) copies of each item shall be forwarded within thirty (30) days to the Department of State Police of the Justice Cabinet.
