Theft Over 5 to 6 Fishing Sinkers
friend got busted was convicted w/o a fair trial then down the road (2 mo.s later) a lawyer whom was hired had it dismissed to do community service for 100 dollar fine and 80 hrs over a 5 to 6 led sinkers for fishing size a little bigger than a pellet gun at fleet farm, there were picture taken and finger printed, info taken in the holding room store ..police took information and cited for court trial.
day of court...he has taken the plea bargain from the beginning w/prosecutor which lead to misdemeanor to petty after a year probation, if a conviction still on the file and had it dismissed which also read under the conviction that would show up on the database...would it make a difference that misdemeanor should still drop down to petty after a year (which has passed over 2 days already of the probation) even though it was dismissed? does it matter?
He has also told me that when he was finger printed for a job 2 weeks ago for background check up through FBI homeland security bec. it's a Bank he applied for...reports came back and 3 has showned up a DWI from 2002 & 1998 and Dosmetic Dispute in 1992...well regardless if he'll get the job or not, it's not a driving job he applied for and I could see if he might not get the job bec. of Domestic Dispute that might keep him getting it bec. Teller position. Although he was finger printed at the store, that itself should of been in the report as well especially for a bank regardless what nature of crime, am I correct? and It should be on the website of which i'm state we' live in to check criminal backgrounds and it's not showing up aside his DWI as well!

Correct about what? What state are we talking about? If he plead guilty, even with the promise of a later dismissal that conviction may very well show up on a background check. Further, even the arrest itself is public knowledge. God help him if he lied on the application. That's even worse than the criminal history as far as most jobs, especially those requiring a large amount of trust like a bank.

it's in Minnesota, the thing is that he was finger printed for background check for work ..the results he received was that the "shoplifting/theft" was not in the report! regardless if he lied or not on application and I have seen/read his (FBI homeland security) finger printing report did not state of the theft conviction/dismissal? and for public criminal viewing website for Mn..it's not there either?
