    My question involves an injury that occurred in the state of: MA

    Hello,

    I thank you for taking the time to read this, so my question is how do I take legal action against someone who tboned a car while she ran a stop sign and the 2nd car swerved onto the sidewalk and hit me while I was on a bike?

    Here is the story:
    So I was riding up to the store on my bike when a lady flew down a small side street and ran straight through a stop sign and tboned an old mans car on the passenger side his car then proceeded to lose control and swerved onto the sidewalk where I was riding my bike the old mans car hit me dead on wrecking my bike, and sent me flying onto the hood of there car where I then went over the side and slid on my back on the cement. Within 10 minutes an ambulance came and all that fun stuff and I was taken to rhode island hospital (some new law that car accident have to be taken to RI hospital as we do not have a local hospital with a trauma center) I did not have any broken bones but my lower left leg and upper right leg are in extreme pain I can't put weight on my left leg and I can't bend my right leg without causeing a lot of pain, I was prescribed 20 5mg Oxycodone HCL and 30 800mg ibuprofen.

    The lady was driving ~35 - 40mph and totaled the car she was driving, she was driving a car with unregistered plates and no insurance (she said she was test driving a car (not from a dealership))

    So I just want to know how can I go about taking legal action against this woman as I am in a lot of pain. I have pictures of all the wounds on me and the hospital papers and pictures from the accident and I have the ruined bike.

    This one is going to be sticky. The first step is to talk to the insurer of the "middle" car and see if they want to handle it. If not, get a lawyer and sue all the parties: the lady, the owner of the car who allowed her to drive thier uninsured car, and the middle man driver. I know that it seems cruel to you to sue the innocent middle man, but that's how it's done.

    Does RI allow bicycles to ride on the sidewalk?

    I am not being snarky. Be prepared for the insurance companies to START by saying if you were operating your vehicle in a manner consistent with the law that you would not have been hurt.

    Personally, I think taking the above advice is going to work out for you. I just want you to be prepared.
