    Accused of Theft Over Items Pawned with Spouse Before Filing Divorce
    My question involves criminal law for the state of: Ohio
    While married and short on cash my soon to be Ex-husband and myself pawned some of our things. Along with those things were some of his parents belongings. Since John had a few bad checks, we used my license to pawn the items. He came into the pawn shop with me on one of the occasions but mostly I went alone. From the time that I pawned the items and the divorce was about 6 months. Now that the divorce is in full swing him and his parents are claiming theft. And they have a "detective" calling me and demanding restitution for full value of all times. There has been no police report of anything official other then then the friend of the family Detective calling me, and requesting that I pay. And be paid off in February when he is retiring. How should I handle this? I am sick with worry! Thank you!
    I was living with them at the time of the "supposed" theft.

    You need to consult a criminal defense lawyer with the full facts, or at least discuss the details with your divorce lawyer.

    What made either of you think you had the right to pawn somebody else's property?

    You can check with the pawn shop to see if they still have security video showing your husband's presence, although it sounds like it's been long enough that they may no longer have it.

    Who is "they"? Either a police report has been filed or it hasn't. Is the "detective" calling you because somebody made a police report (in which case, why is it being assigned to a detective with an apparent conflict of interest) or is he calling you because your husband is his friend?

    Did you fail to redeem the items, such that you defaulted on the loan and they can no longer be recovered by paying off the pawn? If so, does the pawn shop still have the items?
