Ex Refused to Return Children, Then Obtained Child Support
My question involves child support in the State of: Tennessee
Me and husband separated last August. We are not legally separated or divorced. We had established between us that we would do 50/50 custody of our 3 children. When I went to pick the kids up from his house after he had had them over the weekend, he had moved and did not let me know where he moved or anything. He also refused to give me the kids back. He kept the kids from me for about 3 or 4 months and during that time he filed for CS. We went to court and he was granted the CS. I am just wondering if he is legally allowed to do any of this.
Re: Is Ex Allowed to Get Cs
Yes he is.
(That's the short answer).
Without court orders, you both have equal rights to the children and although it's crappy parenting to withhold the kids it's not illegal in this situation.
He is also allowed to file for child support (you both should be supporting the kids).
Re: Is Ex Allowed to Get Cs
Exactly. Until one of you files for divorce, you're on equal ground - he just happens to have been the one to take the children into his care, and as they say, possession is 9/10ths of the law. If you want some OTHER arrangement to be in place, it's time to file in court.
