Distribution of Oxycodone

My question involves criminal law for the state of:florida

Hi I was caught with 140 oxycodone 5/500 this is my first offense. I have no record and im not sure if my lawyer is working for me or the state. on october 11 is my last plea,i have record I was addicted to it but im super clean now an im facing two years in prison then one year house arest then 3 year probation. I dont think she works for me, I think a public defender would have give me 2 year in prison the year of house arest an 3 year probation not my paid lawyer I was hoping for probation only.

I will say at this point, though, that you sentence sounds about right for an oxy dealer with a really good attorney.

Thanks for your opinion. But to get to the point am not or wasnt a dealer I was a user with an addiction. I got caught with 140 of the 5/500. Which is 5mg. As a user I was taking about 15 per day. Do to the affection it came to a point my body did not feel it. But this is my first conviction with prove of my adiction. Also it equal a thousand mg to equal a gram. I was not even close to a gram and they put the max of 28gm so the state can have a case to be able to pick up to convict me. Also oxy has 500 asprin in them so am getting charge for asprin.

You posted this with the subject "Drug Trafficking / Distribution" not possession. If you are in fact charged with simple possession, you should not have described your offense as a distribution offense. If you are stating that you were distributing drugs, but were only doing so to support your habit, you wouldn't be the first.

What is the exact charge against you - the statute number?

I apologize for the incorrect post. My charge is possession with trafficing. 28gm of percocet.Within me am not at peace because I feel that am getting charge a max sentenWhat you think?ce when actually if you do the math it wont equal that amount. percocet carrys a compound which is a certain percent asprin and the one I use carry 500. So in order for them to come to a conclusion of the 28gm I believe they adding the asprin as well.

The "trafficking" part is a distribution charge.

Sounds like you were charged with distribution due to the quantity involved being over what is statute for personal use. Again, what is the statute? If you don't like your free lawyer, pay for one and save the taxpayers some money.

Goodman, you need a lawyer and a better understanding of pharmaceuticals. Percocet does not contain any aspirin. It contains acetaminophen (the ingredient in Tylenol).
The 5/500's have 5mg of oxycodone in them.

However your goose is still cooked. Your argument won't wash. The statutes on the matter read xx grams of oxycodone or the same amount of any MIXTURE containing oxycodone. The fact that more only 10% of the pill is oxycodone doesn't change the level of the crime.

You need a lawyer big time, there's a MANDATORY MINIMUM SENTENCE of 15 years on this.
