Speeding Ticket Deferral in Washington State
My question involves a traffic ticket from the state of: Washington
I was attending a wedding in a rural county and received a speeding ticket for 68 in a 55 while on the highway outside of a town. The officer was coming toward me and I think he picked up a truck in front of me that had just passed me but turned around and pulled me over. I really don't want to take the time off of school and work and go back to this county to battle the ticket and noticed a deferral option and my question is, I was in a wreck about 18 months ago in another county and received a deferral for that wreck ticket (non-speeding ticket deferral). Since I have that deferral on my record, am I eligible for the speeding ticket deferral? I'm a little nervous about going for the deferral, having it denied and then turning around and entering the plea of not-guilty but again, the cop coming toward me had the wrong vehicle.
Re: Deferral Question for Washington State
need to do better than "about 18 mos." is it 17 mos? 12 mos? 20 mos? Post back.
Re: Speeding Ticket Deferral in Washington State
You are eligible for a deferral of ONE "traffic" ticket and ONE "non-traffic" ticket every SEVEN years. As long as your previous deferral was for a "moving" violation (careless, following too close, etc.), you will not be able to get this one deferred.
If I were you, I'd request a contested hearing, submit a discovery request, and then see where you are. Contact the Clerk of the Court listed on your ticket and ask if they allow a "Decision on Written Statements". If so, and you can figure out a defense based on what the officer writes up, you can do it all by mail. This very long thread may provide you with some information that might be helpful, including a template for a Discovery Request.
